Scholarship Application Terms

Smash GC Scholarship (“Program”), offered by LIV Golf Inc. (“LIV”), aims to empower young people beyond the golf course. By submitting an Application, each applicant (and, if an eligible minor, their parent or legal guardian) agrees to abide by these Application Terms and decisions of LIV, which shall be final and binding in all respects relating to all Program.

ELIGIBILITY: Applicants must be legal U.S. residents, who (i) have been members of a golf program for at least 2 seasons, (ii) are graduating high school seniors in the year they are applying, (iii) have a cumulative GPA of 2.5 for all classes taken in high school, (iv) are outstanding in character, integrity, and leadership.

Employees of LIV, its parent, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible. Void where prohibited by law. 

APPLICATION SUBMISSION: Applications will be accepted between 12:00 p.m. Eastern Time (“ET”) on April 30, 2025 and 12:00 p.m. ET on June 30, 2025 (“Application Period”). To submit an application, visit smashgc.com/smash-for-success and follow the directions provided. All applications must be received by 12:00 p.m. ET on June 30, 2025 to be considered. Limit one (1) application per Applicant. Applications received for any applicant in excess of the stated limitation will be void. Applications generated by script, macro or other automated means or by any means which subvert the application process are void. All Applications become the property of LIV and will not be acknowledged or returned. 

REQUIREMENTS OF APPLICATIONS: Application must be true and verifiable and reflect the applicant’s own experiences and beliefs. Application must be applicant’s own work product (with the exception of the letters of recommendation), may not have been previously published, and may not have won previous awards. LIV, in its sole discretion, may disqualify your application for any reason, including if it determines that your application fails to conform to these Application Terms in any way or otherwise contains unacceptable or inappropriate content. LIV reserves the right to verify the validity of any letter of recommendation.

SCHOLARSHIP RECIPIENT DETERMINATION: All eligible applications received for a Program will be reviewed based on, among other things, applicant’s character, integrity, and leadership as proven during participation in extracurricular, civic, or community activities. LIV reserves the right to not provide the Award (as defined below) if, in its sole discretion, it does not receive any eligible and qualified applications. All decisions of LIV are final and binding. LIV will not provide feedback on any application. 

SCHOLARSHIP RECIPIENT NOTIFICATION AND REQUIREMENTS: The potential recipient will be notified by email and will be required to respond to initial notification within 72 hours. Potential recipient (and, if an eligible minor, their parent or legal guardian) may be required to execute and return a Declaration of Eligibility, Liability and, unless prohibited, Publicity Release as well as a W-9 Form. If a potential recipient does not respond to the initial notification within the time period stated, does not return all required documentation within the time period stated, or if any notification is returned as undeliverable, or a potential recipient is not in compliance with these Application Terms, Scholarship will be forfeited and, at LIV’s sole discretion, a runner-up may be notified.

Potential recipient must be able to attend a LIV Golf tournament in 2025 to be determined at LIV Golf's sole discretion (the "Tournament"), and be willing to talk to a group of high schools seniors hosted at the first tournament in 2026. If the potential recipient is unable attend the Tournament and/or is unwilling to speak to a group of high school seniors hosted at the first tournament in 2026, they will be disqualified and, at LIV’s sole discretion, a runnerup may be notified.

SCHOLARSHIP: $5,000 check made payable in the name of the recipient and a trip for recipient (and, if an eligible minor, their parent or legal guardian) to the Tournament (“Trip”) (collectively, the “Award”). Approximate Retail Value of Award: $6,500.

Trip includes round trip, coach-class air transportation for recipient and, if an eligible minor, a parent or legal guardian) from a major airport near Recipient’s home (determined by LIV in its sole discretion) to a city near the Tournament; two (2) nights' accommodations at a hotel determined by LIV in its sole discretion (one (1) room, double occupancy); tickets to the tournament. All travel arrangements will be made through LIV’s agent. Recipient must travel on the dates determined by LIV in its sole discretion or trip will be forfeited. Notwithstanding the foregoing, LIV will make reasonable efforts to select travel dates acceptable to recipient. Trip must be booked at least twenty-one (21) days prior to departure. Travel and accommodations are subject to availability and blackout dates. Travel must be round trip. LIV will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth herein, and those set forth by the LIV’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs associated with Trip acceptance and use not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, gratuities, baggage fees, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of recipient. Parent or legal guardian must travel on same itinerary and at the same time as the recipient. Parent or legal guardian must execute liability/publicity release prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply.  If in the judgment of LIV air travel is not required due to recipient’s proximity to trip location, ground transportation will be substituted for round trip air travel at LIV’s sole discretion and no compensation or substitution will be provided for difference in trip value. LIV will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Actual value may vary based on airfare fluctuations and distance between departure and destination. Recipient will not receive difference between actual and approximate retail value. LIV is not responsible if the tournament is delayed, postponed or cancelled for any reason, and no substitution will be provided except as in LIV’s sole discretion. Tickets may be subject to LIV’s standard rain-check policies and procedures. By accepting ticket trip, recipient agrees to abide by any terms, conditions and restrictions provided by the ticket.  Recipient and parent or legal guardian agree to abide by all venue rules and regulations.  Failure to do may result in forfeiture of Trip.

All federal, state and local taxes, if any, and all other costs and expenses associated with Award acceptance and use not specified herein as being provided are the sole responsibility of the recipient. Recipients may not substitute, assign or transfer Award.  Award is not redeemable by recipient for cash. All Award details are at LIV’s sole discretion. 

PUBLICITY GRANT AND LICENSE/USE OF APPLICATIONS:  By submitting and/or accepting a Application, each applicant (and, if an eligible minor, their parent or legal guardian) waives all moral rights in and to the Application and grants to LIV and its licensees, successors, designees, and assigns an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to reproduce, distribute, display, exhibit, exploit, perform, edit, create derivatives of, and otherwise use the Application and all elements of such Application, together with any other material, and the name, city and state of residence, voice, image and/or likeness of applicant, in any and all media now known or hereafter devised, in any manner, in whole or in part, worldwide, without compensation or notification to, or permission from, applicant or any third party, for any purpose whatsoever, including without limitation, for purposes of advertising or trade. Applicant (and, if an eligible minor, their parent or legal guardian) agrees that, if required by LIV, he/she will sign documents to this effect. LIV has no obligation to make use of the rights granted herein. 

GENERAL CONDITIONS:  By participating, each applicant (and, if an eligible minor, their parent or legal guardian) agrees to release, discharge and hold harmless LIV, its parent, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from applicant’s participation in a Program or any Program-related activity or the acceptance, possession, use or misuse of the Award (including any travel or activity related thereto). 

Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled applications, emails, messages or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with a Program, including, without limitation, errors or difficulties which may occur in connection with the administration of a Program, the processing or review of Applications, the announcement of the Award recipient or Award itself, or in any Program-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program. Released Parties are not responsible for injury or damage to any person's computer or other device related to or resulting from participating in this Program. Persons who tamper with or abuse any aspect of a Program or any website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Application Terms, as solely determined by LIV, will be disqualified and all associated Applications will be void. Should any portion of a Program be, in LIV’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of LIV, corrupt or impair the administration, security, fairness or proper play, or submission of Applications, LIV reserves the right at its sole discretion to suspend, modify or terminate the Program. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF A PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, LIV RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

APPLICABLE LAWS AND JURISDICTION:  These Programs are subject to all applicable federal, state and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Application Terms shall be governed by the laws of the State of New York.
